France Just Taxed The "safe" Move In Crypto. Every Web3 Founder In Europe Should Be Paying Attention
France Just Taxed The "safe" Move In Crypto. Every Web3 Founder In Europe Should Be Paying Attention

When a government starts taxing the act of reducing risk, the rules of the game have changed.

    What Just Happened

On October 7, 2026, France’s Finance Committee passed Amendment n° I-CF1826 to the 2027 draft budget bill. It passed 38 to 37.

    One vote.

The amendment does something that sounds technical but has a very practical consequence: it ends the tax deferral on crypto-to-stablecoin conversions. Under current French law, swapping crypto into a stablecoin is treated as a crypto-to-crypto exchange, which defers tax until you actually convert to euros or spend the money. From January 1, 2027, that changes. Swapping into a MiCA-compliant stablecoin, which covers most major fiat-pegged tokens, becomes a taxable event at France’s existing 31.4% flat tax rate.

The amendment still needs full-chamber debate, a solemn vote around October 20, and Senate approval before it becomes law. But the direction is clear. And the logic behind it is more revealing than the vote itself.

Why Taxing The Safe Move Matters

To understand why this is significant, you need to understand what swapping into a stablecoin actually means in practice.

When a crypto holder moves their Bitcoin or Ethereum into USDC or USDT, they are not cashing out. They are not realizing a gain in any meaningful economic sense. They are reducing their exposure to volatility while staying in the crypto ecosystem. It is the equivalent of moving from stocks into cash inside a brokerage account. No country taxes that move as a realized gain.

    Until now.

The French amendment’s explanatory memo calls stablecoins investment vehicles and argues that existing treatment is a hole in the legislation. The logic is that stablecoins are liquid, usable for payments, and can be deployed into further crypto purchases without passing through the traditional financial system. Therefore, converting to them is close enough to cashing out that it should be taxed accordingly.

That logic is coherent from a revenue standpoint. It is also, as several experts pointed out immediately, economically unjust and practically punishing.

Austin Yuanlun Yin, a US-licensed CPA, warned the reform “risks punishing innovation” and that heavy taxation will push capital abroad quickly. Joe David, CEO of Nephos, said the bill “risks oversimplifying” the landscape and could “inadvertently penalize productive capital.”

These are not crypto maximalists complaining about taxes. These are practitioners pointing out that the amendment does not distinguish between a retail investor reducing risk and a founder managing treasury in a way that keeps a company functional.

    The Specific Problem For Founders

Here is the scenario the amendment creates for any Web3 founder operating in France.

You raise a funding round in ETH. The market drops. You want to convert your runway to stablecoins to protect it while you build. Under the current regime, that conversion is tax-deferred until you actually spend or convert to fiat.

Under the proposed amendment, that conversion is a taxable event at 31.4%.

So you have two choices. You either hold ETH and risk your runway evaporating in a bear market. Or you protect your runway, trigger a 31.4% tax on gains you have not realized in any meaningful economic sense, and potentially owe a significant tax bill on money you need to operate.

That is not a tax on profit. That is a tax on prudence.

And it lands hardest on early-stage companies with large paper gains on early token allocations or funding rounds. The companies most likely to need to convert for treasury management are exactly the ones with the highest theoretical gains and the least liquidity to pay a surprise tax bill.

    The Broader European Context

France did not arrive at this alone. The amendment explicitly references the UK and Italy as precedents. Both countries already treat crypto-to-stablecoin conversions as taxable events.

This is a pattern. As stablecoins become more mainstream and more integrated into financial infrastructure, European governments are watching a significant amount of economic activity move into a space they cannot easily monitor or tax. The response is to treat every movement within that space as a potential taxable event, removing the friction advantage that made crypto-to-crypto and crypto-to-stablecoin conversions attractive in the first place.

The EU’s MiCA framework adds another layer to this. MiCA distinguishes between compliant and non-compliant stablecoins. The French amendment specifically applies to MiCA “electronic money tokens,” which covers the major regulated stablecoins. Non-compliant stablecoins may not be covered, which creates a perverse incentive: using less regulated, less transparent stablecoins to avoid the tax.

That is almost certainly not what the legislators intended. But it is the logical consequence of drawing the tax line at MiCA compliance.

What The Vote Count Tells You

    38 to 37.

That margin is worth dwelling on. This is not a broad political consensus that crypto conversions should be taxed. This is a single-vote majority in a Finance Committee passing an amendment that the full chamber will now debate.

It is also not the only crypto-related measure moving through European legislatures right now. The EU and eight countries signed the Warsaw Convention protocol this week, bringing virtual assets and VASPs into scope for international asset-recovery frameworks. South Korea is meeting its five largest exchanges this week to discuss crypto taxation. Latvia is considering letting residents pay taxes in crypto. France is moving to tax the safety net.

The direction across Europe is consistent: more visibility, more reporting, more taxable events, and a tightening of the gray areas that made crypto operations advantageous compared to traditional finance.

None of this kills Web3 in Europe. But it does meaningfully change the calculation for founders choosing where to build and where to manage their treasuries.

What This Means For Web3 Marketing

There is a less obvious implication here that matters for anyone building or marketing in the Web3 space.

The narrative around stablecoins has been, largely, one of infrastructure. Stablecoins enable faster payments, cheaper remittances, better treasury management. They are the bridge between crypto and real-world utility. That narrative has been extremely effective at getting banks, payment networks, and institutional players interested.

But as stablecoins become more regulated, more visible, and more taxable, that infrastructure narrative gets more complicated. If moving into a stablecoin triggers a 31.4% tax event in France, and similar rules spread to other European countries, stablecoins are no longer a seamless bridge. They are a toll road.

That changes the pitch to enterprise clients. It changes the product requirements for wallets and exchanges operating in Europe. And it changes the compliance burden for any founder managing a treasury in a jurisdiction that follows France’s lead.

The marketing challenge for stablecoin projects in Europe just got significantly harder. “Use our stablecoin to manage risk” now comes with a footnote that could cost your client a third of their theoretical gains.

    What Comes Next

The amendment still needs to pass the full chamber vote around October 20 and then survive the Senate. Amendments at this stage often get modified, rejected, or delayed. A one-vote margin in committee is not a guarantee of anything.

But the legislative intent is clear. And even if this specific amendment fails this cycle, the question of how to tax stablecoin conversions is now formally on the French legislative agenda. It will come back.

For founders and operators in Europe, the practical advice is straightforward: get clarity on your jurisdiction’s current rules before year-end, understand what a 2027 implementation date means for any treasury operations you run in France, and watch the Senate vote closely.

For everyone else watching European crypto regulation, the France amendment is a signal about where the continent is headed. The more stablecoins look like real financial infrastructure, the more governments will treat them like it. Including the taxation.
