    Helping Politicians Understand Bitcoin Privacy: A Challenge Ahead

    Over the past few weeks, I’ve engaged in discussions with several politicians. They predominantly view Bitcoin as a viable store of value and advocate for the right of U.S. citizens to maintain control over their private keys.

    It is undoubtedly uplifting to hear U.S. lawmakers expressing these sentiments and even introducing legislation aimed at solidifying pro-Bitcoin policies. This positive shift is especially welcome following the adversarial stance toward Bitcoiners and the cryptocurrency sector during the Biden administration.

    However, significant efforts are still required, particularly in advocating for our right to conduct Bitcoin transactions with privacy intact.

    One of the most effective privacy-enhancing solutions available at the Bitcoin base layer is Bitcoin mixers, which allow users to obfuscate their transaction details.

    A prominent mixer known for its noncustodial approach was Samourai Wallet, which empowered users to mix their Bitcoin without the developers ever accessing their private keys.

    Unfortunately, this service was shut down early last year when the U.S. Department of Justice (DoJ) filed charges against Samourai’s developers for operating an unlicensed money transmission service and for conspiracy related to money laundering. (Similarly, the developers of Tornado Cash, an open-source mixer on the Ethereum network, are also facing charges of this nature.)

    Support for Samourai’s developers has emerged from certain politicians, including Senator Cynthia Lummis (R-WY) and Ron Wyden (D-OR), who have collaboratively drafted a letter to former U.S. Attorney General Merrick Garland. In this letter, they argued that the developers were not running a money transmission business as defined by FinCEN guidance issued in 2019. It’s worth noting, however, that Senator Lummis also co-sponsored a legislation advocating for a study on combating anonymous crypto asset transactions including mixers, but I digress.

    Mixers play a crucial role for human rights advocates who must ensure their anonymity in transactions, as well as for everyday individuals who prioritize privacy in their financial dealings.

    Consequently, it is essential to highlight this issue to lawmakers, many of whom may not be well-informed about it. The goal is to encourage a larger number of them to advocate for the Samourai developers and recognize the significance of safeguarding U.S. citizens’ right to utilize mixing services.

    I urge you to leverage the letter template authored by my colleague Shinobi, located at the end of this article, to communicate with your elected officials.

    Just as we have united to Free Ross and advocate for the right to self-custody, we must also rally to uphold the principle of transactional privacy.
